Insurance

Negligence
In order to make a road traffic accident claim you must be able to pinpoint someone who was to blame. This involves the concept of negligence which occurs when a driver has failed to take adequate care. The driver can be either the driver of the vehicle in which you were travelling or can be the driver of another vehicle on the road. Whether or not you are friends with the driver or related to the driver is irrelevant. You can still make a road traffic accident claim if you are injured due to negligence. A claim for compensation for personal injury must have been settled or legal proceedings must have been issued in a court of law within three years of the accident failing which the claim will become barred due to the lapse of time and the opportunity to claim may have been lost forever. There are a few technical exceptions to this general three year rule for minors and the mentally handicapped.

Compensation Awards
Many people don’t know what can and what cannot be included in a road traffic accident claim. The rules are relatively straightforward and, provided that the losses were reasonably foreseeable then they can be claimed. Losses are put into two basic categories by lawyers and are termed as general damages which represent compensation for losses that can be calculated easily and with some degree of accuracy and special damages which represent compensation for losses that cannot be exactly calculated and need a degree of assessment. Time Limits
The Limitation Act 1980 determines the applicable time limits for making claims for personal injury which must be either settled or legal proceedings must have been issued within three years of the accident. There are exceptions to this general rule for those under the age of 18 years at the time of the accident, for those who are mentally disabled and in cases where the injury was not apparent immediately following the accident. Failure to abide by the time limits may mean that the potential claim becomes statute barred and the opportunity to claim compensation may be lost forever.
