MOTOR INSURERS BUREAU MIB COMPENSATION CLAIMS
The Motor Insurers Bureau was set up by Government to administer a fund that pays compensation to the victims of negligent uninsured car drivers or negligent untraced hit and run drivers. The M.I.B. fund is financed by a levy on all UK motor insurance companies and is therefore effectively paid for by all motor vehicle users as a proportion of each motor insurance premium is paid into the fund by the insurers.

Uninsured Drivers
In the case of an uninsured driver, the claim is dealt with in almost exactly the same way as it would be if the claim was against an insured car driver. Negotiations for settlement of the claim will be with the Motor Insurers Bureau rather than an insurance company. The MIB imposes a nominal excess of £300 and compensation for injuries and other losses and legal fees are paid in full, subject to the nominal excess being deducted. Losses that can be claimed include pain and suffering, loss of income, vehicle repair costs, replacement vehicle hire, medical expenses and prescriptions. Claims against uninsured drivers inevitably take longer to resolve than if the car driver was insured. It is usually necessary to instigate court proceedings and obtain judgement and the Motor Insurers Bureau usually settles any judgement obtained after the expiry of seven days, if the judgement remains unsatisfied provided that they have been given proper procedural notice.

Untraced Drivers
If the other driver was untraced or unidentified as in a hit and run accident, then a claim can be made to the Motor Insurers Bureau for compensation for pain and suffering including psychological injury and for those losses resulting directly from the injuries sustained. If the decision of the Motor Insurers Bureau on liability or the amount of the award is not found to be satisfactory then an appeal can be made. The other very important difference in making an MIB claim as a result of an accident caused by an untraced driver is that the MIB will only make a contribution to the solicitors legal costs in addition to paying disbursements including medical report fees. The overall legal costs of most claims will be more than the contribution and the balance will be deducted from any award.
