UNINSURED & UNTRACED DRIVERS
HIT & RUN COMPENSATION CLAIMS

The Motor Insurers Bureau (MIB) is a company founded by government to pay compensation to the victims of the users of motor vehicles who do not have a valid policy of insurance to cover third party risks. All motor insurance companies must pay an annual levy to the MIB to fund uninsured or untraced driver (hit and run) claims. The MIB will pay out either in the case when the guilty party cannot be found because they have escaped the scene unidentified or when they do not have insurance. These claims are not always straightforward – there are complicated rules and technicalities involved in MIB applications especially for untraced hit and run incidents.

Motor Insurers Bureau

The MIB operates two specific uninsured driver claims schemes for compensation :-

  • Uninsured Driver Agreement

    This allows the victims of car accidents caused by uninsured drivers to still seek compensation with the assurance that if successful the Motor Insurers Bureau will pay the compensation award. In order to succeed in a claim under the Uninsured Driver Agreement, the MIB require the victim to obtain judgement against the negligent driver in a court of law. Almost all losses can then be claimed in the same way as if the uninsured driver was actually insured. The MIB also pay the victim’s legal costs in full thereby ensuring that compensation paid to the victim is received in full with no deductions. The MIB then recovers their outlay from the uninsured driver over time or by entering a charge against any property that they may own to be settled on sale of that property in due course.

  • Untraced Drivers Agreement

    This allows victims to make a claim to the Motor Insurers Bureau in a hit and run accident, even when the driver who caused the accident cannot be found or identified over time. There is often a strong criminal element involved in a hit and run accident. Except for a small contribution which includes expenses and disbursements, any legal costs incurred by the applicant are not payable by the MIB under the Untraced Drivers Agreement and there will be a deduction from the compensation received to cover the solicitors legal costs. This is the only situation in which a deduction is made to compensation.
