Foreign Time Limits
Foreign limitation periods can be substantially different to those in the UK whereby a personal injury claim must normally have been settled or proceedings issued within three years subject to certain exceptions. The limitation period in the USA can be as short as 6 months dependant on the state and identity of the potential defendant. For safety, urgent legal advice should always be sought on a possible holiday accident claim from an experienced solicitor at the first possible opportunity to avoid the potential loss of opportunity to claim damages due to the expiry of the relevant limitation period.

Package Holidays & Package Tours Regulations 1992
These Regulations came into force on the 23 December 1992 and cover most package holidays and the individuals or bodies who organise or retail them including travel agents. In the event of failure to meet the requirements a lawyer can take legal action for compensation. The tour operator must provide reasonably suitable accommodation which must meet any standards and have any facilities that have been described in any brochures or advertisements. The holiday company is responsible if the resort does not meet these standards. The organiser and the retailer are required to provide comprehensive information about the holiday to the consumer both before a contract is entered into and a reasonable
time before the travel package itself is taken. The Regulations also require that organisers and/or retailers provide
sufficient evidence of security for the refund of money paid over and for the repatriation
of the consumer in the event of insolvency of the holiday company.
