The purpose of the payment of personal injury damages in a product liability compensation claim is designed to place the injured party back into the position they were in prior to the incident which caused the injury. The United Kingdom system of assessment considers previous compensation awards made in earlier cases to decide upon a fair assessment and valuation of damages. Records are available of most important previous cases and there is a full record of all higher court cases. Solicitors and barristers use a publication called “Kemp and Kemp” when assessing the value of personal injuries. This publication is a multi-volume guide to previously decided cases ranging from minor injuries to severe injuries. The publication also contains explanations of the law and has numerous footnotes for guidance to help make accurate assessment of damages as simple as possible. “Kemp and Kemp” can be found in most solicitors’ offices, as well as in most public libraries.

Damages Assessment
When a product liability claim is under consideration, the judge will look at many factors, including the extent of the injury, the pain and suffering caused by the injury and any current, permanent or ongoing disabilities. A judge will use previously decided cases similar in nature to help assess the calculation of the amount of compensation to be awarded. In addition a judge will use his own personal experience from his time as a practicing solicitor or barrister and from his time spent in the judiciary and will also be guided by a publication called “'The Judicial Studies Board Guidelines for the Assessment of General Damages in Personal Injury Cases” to make his final assessment of compensation. Although this publication outlines a tariff system, for damages awards, the amounts cannot always be taken at face value and serve only as a guide. There are many accidents caused by defective products which result in multiple injuries and the values described by the tariff system cannot simply be added together to come up with the total award amount. Consideration and judgment need to be carefully applied with some of the individual tariff values being reduced and some being uplifted in cases involving more than one injury.
