Compensation Awards

Traumatic Brain Injury (TBI) is a tragic event that happens unexpectedly as a result of a blow to the head or severe jolting and shaking of the skull. Due to the sensitive nature of the brain the exact consequences of this kind of event can vary greatly from person to person. Full recovery may be made from minor damage but in other cases there can be long term problems for the individual victim and for everyone who cares for or about the individual. Problems can be experienced with talking, movement, reasoning, vision and hearing, speaking and learning. Other symptoms can include headaches, migraines, loss of memory, lack of balance, general fatigue, muscle problems, seizures and paralysis of parts of the body. Anyone suffering from these problems caused as a result of an accident due too third party negligence should take urgent legal advice from a brain injury solicitor. Settlements can be substantial in cases of catastrophic damage with the majority of large compensation awards relating to future needs and care for those victims who are severely disabled.

Time Limits

The Limitation Act 1980 determines the applicable time limits for making claims for personal injury which must be either settled or legal proceedings must have been issued in a court of law within three years of the accident. There are exceptions to this general rule for those under the age of 18 years at the time of the accident, for those who are mentally disabled and in cases where the injury was not apparent immediately following the accident. Failure to abide by the time limits may mean that the potential claim becomes statute barred and the opportunity to claim compensation may be lost forever. If in any doubt about these matters take immediate qualified legal advice.
