In 1995 there was an historic asbestos cancer claim in the High Court when a Judge ruled that there was a direct correlation between environmental exposure and illness suffered by people living near a Leeds factory which made special textiles from asbestos. The claimants in the case suffered from an asbestos related disease known as mesothelioma which is a form of asbestos cancer. In the case, it was claimed that the illness was caused by exposure, fifty years previously, when as children, the claimants played in the vicinity of the factory. Evidence was presented which showed that fibres were released into the atmosphere from the factory and that employees left the factory covered in mineral dust, thus causing extensive contamination of their homes and of the residential areas surrounding the factory. The Judge in the case ruled that reasonable steps were not taken to reduce emissions of asbestos dust, which has been a recognised health hazard since 1933. Exposure to these dangerous fibres is linked to mesothelioma which is a cancer of the cells that make up the lining around the outside of the lungs and around the abdominal organs. It was decided that the factory owed the local resident’s a duty of care which was breached by the factory owners for not taking reasonable steps to prevent contamination and as a result the owners were liable to pay compensation in the asbestos cancer claim.

Multi Party Action & Group Action
Legal action for an asbestos cancer claim due to environmental pollution or workplace contamination can be pursued in a court of law. In the event that the proposed defendant denies liability for negligence and refuses to pay compensation for injury to health then group legal action may be feasible. It is possible to pool resources and take group legal action when there have been a number of people affected, particularly when the same (or similar) injuries/illnesses have been suffered at approximately the same time.
