Accident compensation claims that can be made include;

  • General Damages cannot usually be calculated precisely and represents payment for ‘pain and suffering’ for both the initial injury and for any ongoing suffering or disability and for ‘loss of amenity’ which includes payment for not being able to do the things that contribute to the enjoyment of life. Damages for 'loss of amenity' are designed to compensate for being unable to pursue the kind of lifestyle enjoyed prior to the accident or the lifestyle that could have been expected if the accident had not occurred. Also in this category is damages payable for ‘disadvantage on the open labour market’ which means that if there is a possibility of change of employment in the future and the injury may restrict opportunity then a sum for damages is payable. In addition damages may be payable for ‘loss of congenial employment’ which is appropriate when the employment provides specific job satisfaction and can no longer be pursued as a result of the injury. These damages are assessed following consideration of previously decided cases and by reference to ‘The Judicial Studies Board Guidelines’.
  • Special Damages represents payment for losses and expenditure and these are items that are usually easy to calculate accurately. There is little restriction on what can be claimed provided that the expenses or losses have been reasonably incurred and arise directly from the accident. Items of loss and expense are usually valued with the help of independent experts who individually assess needs and prepare recommendations and costings. It is important to retain receipts and keep a note of all expenses that are incurred.
    Special damages for accident compensation claims may include;
    • loss of future salary
    • loss of past pay
    • damage to property
    • prescription charges and medical fees
    • car hire
    • lost insurance premiums
    • costs of assistance for household chores
    • travelling expenses
    • insurance excess
    • special care aids and equipment
    • vehicle crash damage
    • cost of care and assistance
    • therapies
    • adapted accommodation
    • adapted transport
    • out of pocket expenses

  • Future losses can also be claimed and the calculation of this aspect can be very complex. If losses are liable to continue into the future then a special calculation is applied to the estimated annual loss to arrive at a fair figure. A discount is applied to this figure due to the fact that the money is being paid early in a lump sum and can be invested.
